1. Agreement
Accessing or using services provided by Evocare Telehealth Ltd (“Evocare”) constitutes acceptance of these Terms & Conditions.
2. Services Offered
Evocare provides telehealth and remote healthcare services, healthcare communication software, digital clinic transformation tools, web-based platform access, and utility-token-based platform features where enabled. Evocare does not provide emergency medical care.
3. User Responsibilities
Users must provide accurate information, safeguard login credentials, use the platform lawfully, and refrain from attempting to breach security or technical controls.
4. Token Functionality
Any tokens provided are utility tokens only and do not represent investments, ownership, equity, profit participation or financial instruments. Users remain solely responsible for wallet security, private keys and transaction execution. Evocare cannot reverse blockchain transactions and provides no financial or investment advice.
5. Fees
Applicable fees are published transparently. Any blockchain transaction or token-related fees are the sole responsibility of the user.
6. Limitation of Liability
Evocare shall not be liable for token loss caused by user error, blockchain network failures, indirect damages, or service downtime beyond reasonable control.
7. Changes to Terms
Evocare may amend these Terms to reflect legal, regulatory, technical or operational changes.
8. Regulatory Compliance Notice
Evocare operates in accordance with UK GDPR, the Data Protection Act 2018, UK telehealth governance, AML/CTF regulations, and the FCA financial promotions regime. Tokens are not FCA-regulated financial products unless explicitly stated.
9. Token Risk Disclosure
Utility tokens involve risks including price volatility, total loss of value, irreversible transactions, network delays, technical failures and regulatory changes. Users must assess personal suitability and risk tolerance.
10. FCA Cryptoasset Risk Warning
Cryptoassets are high risk. You may lose all the money you invest. They are not regulated by the Financial Conduct Authority (FCA), and you may not have access to compensation or dispute resolution mechanisms. Do not invest unless you are prepared to lose your entire investment.
11. B2B Terms & Conditions
Separate B2B Terms apply to contracts with business clients, public entities and institutions. These govern scope of services, intellectual property, consulting deliverables, utilisation obligations, fees, payment terms, liability, confidentiality, termination, jurisdiction and governing law (England and Wales).
12. Data Processing Agreement (DPA)
Where Evocare processes personal data on behalf of clients, a Data Processing Agreement forms an integral part of the contract in accordance with UK GDPR and the Data Protection Act 2018. The DPA governs processing instructions, security measures, sub-processors, international transfers, breach notifications, audit rights and termination obligations.
13. Token & Blockchain Addendum
Any token or blockchain-related functionality is governed by a Token Addendum forming part of these Terms. It defines token nature, user responsibilities, compliance obligations, risk disclosures, liability limitations, suspension rights and governing law (England and Wales).
14. Governing Law
These Terms & Conditions are governed exclusively by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.
